ICC issues guidelines for the creation of BPO customer contracts

25/08/2015 Following a request from a number of banks, ICC and SWIFT formed a drafting group under the chair of Gary Collyer to create guidelines to assist banks when creating customer agreements relative to the use of the BPO and associated bank products and financing solutions. LC requires an air waybill issued to the order of the issuing bank. Air waybill is presented and on the right top corner it states "not negotiable air waybill" and it is issued to the order of the issuing bank as per LC terms. Air waybills should not be required to be made out to the order of the issuing bank in the first place. But as this is the case, and as being the confirming bank, do you think we can accept the document as credit complying despite the "not-negotiable" notation?
